Actually, there are many legal precedence set, as can be found in the Star Citizen Refund reddit. The Kickstarter money may or may not be legally refundable, but the donations post-KS are certainly subject to refund, although actual values may vary based on local laws.
That being said, I watched the video you linked from YouTube, and I’m not sure what point you were trying to make with it. While it is true that RSI/CIG’s statement is yet to be revealed, much of what was said appears very black and white, and I have a hard time believing much of it would be fabricated. RSI/CIG actually said in their current statement that they “Have not used CryEngine in a very long time,” but since that would go against the GLA terms (and without having any proof TO DATE of the GLA being invalidated), that seems particularly strange of a counter-statement to make.
It will be interesting to watch it all unfold, or watch as much as we can (as a couple videos have stated, Amazon is in the game now, and Amazon hates publicity). I would be extremely surprised to find out the GLA does not apply, although the Copyright portion of the suit is likely to be up in the air and will probably take a long time to come down, if it ever does.
